These Terms of Service (“Terms”) are an agreement between you and McMouse Management Pty Ltd, the operator of Pinsmack (“Pinsmack”, “we”, “us” or “our”).

These Terms apply when you access or use the Pinsmack website, mobile applications, digital reading platform and related services (collectively, the “Services”).

By creating an account, purchasing a subscription or using the Services, you agree to these Terms.

If you do not agree to these Terms, you should not use the Services.

1. Pinsmack

Pinsmack is a subscription-based digital reading service providing access to books and related reading features.

Depending on your subscription, device and location, the Services may include:

access to the Pinsmack digital library;
household profiles;
Kids Mode or kids profiles;
personalised recommendations;
reading progress and bookmarks;
offline downloads;
reading across supported devices; and
other features introduced by Pinsmack.

The features and content available through Pinsmack may change as the Services develop.

2. Your Account

You must create a Pinsmack account to access subscription content and certain features.

You agree to provide accurate information when creating and maintaining your account and to keep your account information reasonably current. You are responsible for activity occurring through your account and household profiles.

If you believe your account has been accessed without your permission, contact us promptly at support@pinsmack.com.

Pinsmack may use identity or account verification measures, including mobile verification, to protect customer accounts and the Services.

3. Household Profiles

A Pinsmack subscription may allow you to create multiple profiles within your household.

The number of profiles available may depend on your subscription plan.

The account holder is responsible for:

managing household profiles;
controlling access to the account;
managing Kids Mode and kids profiles; and
ensuring household members use Pinsmack in accordance with these Terms.

Profiles do not constitute separate subscriptions or independent ownership of Pinsmack content.

4. Children and Kids Mode

A person must be at least 18 years old to create and control a Pinsmack account or purchase a subscription.

A parent or legal guardian may permit a child to use Pinsmack through an appropriate household profile or Kids Mode.

The account holder remains responsible for supervising a child's use of the Services and determining whether particular content is appropriate for that child.

Kids Mode is intended to provide access to content selected for younger readers, but parents and guardians should make their own decisions about whether individual books are appropriate for a child's age, maturity and circumstances.

5. Subscriptions

Access to subscription content requires an active Pinsmack subscription unless we expressly provide access through a trial, promotion or other arrangement.

Subscription plans, prices, billing periods, included features and household limits are displayed when you subscribe.

Your subscription continues for the applicable subscription period and may automatically renew until cancelled where automatic renewal applies.

The price, renewal frequency and applicable terms will be disclosed before you purchase the subscription.

6. Billing

Depending on where you subscribe, payments may be processed by Pinsmack or by a third-party payment provider or app marketplace. If you subscribe through a third-party provider, your payment and certain aspects of subscription management may also be subject to that provider's terms. Where your subscription automatically renews, you authorise the applicable payment provider to charge the subscription price and applicable taxes or charges at each renewal until the subscription is cancelled.

If payment cannot be successfully processed, access to subscription content may be suspended or expire until the subscription is restored or another valid payment arrangement is established.

7. Trials and Promotional Offers

Pinsmack may offer free trials, introductory pricing, promotional offers or other subscription incentives. Eligibility, duration and conditions may vary and will be disclosed with the relevant offer. Unless otherwise stated, a trial or promotional subscription that converts to a paid subscription may automatically renew at the disclosed subscription price unless cancelled before the applicable renewal date.

Promotional offers may be restricted to eligible customers and may not be available to previous subscribers.

8. Cancellation

You may cancel a Pinsmack subscription at any time.

Cancellation stops future renewals but will generally not immediately terminate access that has already been paid for. Unless otherwise stated, you may continue using the subscription until the end of the current paid billing period. The method for cancelling depends on where the subscription was purchased.

Subscriptions purchased through Apple, Google or another third-party marketplace may need to be cancelled through that provider. Deleting your Pinsmack account does not necessarily cancel a subscription managed by a third-party provider. You should cancel any externally managed subscription separately.

9. Refunds and Consumer Rights

Refund eligibility may depend on where your subscription was purchased and the circumstances of the request.

Subscriptions purchased through Apple, Google or another third-party marketplace may be subject to that provider's refund process. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under Consumer Law or other applicable law. Where you are entitled to a refund, cancellation, replacement service or other remedy under applicable law, these Terms do not limit that right.

10. Licence to Use Pinsmack Content

Pinsmack provides access to digital content under licence.

Purchasing a subscription does not transfer ownership of Pinsmack books or other content to you.

While you have the required access rights, Pinsmack grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the content made available to you through the Services.

This licence is for personal, non-commercial use only.

Except where permitted by law or expressly authorised by Pinsmack, you must not:

sell or resell Pinsmack content;
reproduce or redistribute content;
upload or share books with other people or services;
publicly display or perform content;
commercially exploit content;
create unauthorised copies of content; or
use Pinsmack content for a commercial or promotional purpose.

11. Intellectual Property

The Pinsmack Services and content available through them, including books, text, artwork, graphics, branding, images, audio, software, interfaces and related materials, are owned by McMouse Management Pty Ltd or the applicable rights holder.

Pinsmack and associated branding, logos and marks are protected by applicable intellectual property laws.

Except for the limited right to use the Services provided under these Terms, no intellectual property rights are transferred to you.

All rights not expressly granted are reserve

12. Content Protection

Pinsmack may use technical measures to protect digital content and prevent unauthorised copying or distribution.

You must not deliberately circumvent, disable, interfere with or bypass content-protection or access-control measures used by Pinsmack.

You must not attempt to obtain Pinsmack content through methods other than those provided or authorised by the Services.

Unauthorised copying, distribution or circumvention may result in suspension or termination of access and may also infringe intellectual property or other applicable laws.

13. Offline Downloads

Certain content may be available for offline reading.

Offline downloads remain licensed Pinsmack content and are not purchased copies.

Access to downloaded content may depend on:

your account remaining active;
your subscription status;
the applicable household profile;
periodic verification by Pinsmack; and
continued availability of the content.

When your subscription or entitlement ends, access to downloaded subscription content may also end.

14. Content Availability

Pinsmack's library will change over time.

Books may be added, updated, corrected, replaced, temporarily unavailable or removed.

We do not guarantee that a particular book will remain available indefinitely or that particular content will be released on a particular date unless we expressly make such a commitment.

Where a material change affects a paid service, your rights under applicable consumer law remain unaffected.

15. Acceptable Use

You must not misuse Pinsmack or interfere with the operation or security of the Services.

You must not:

access another person's account without permission;
attempt to gain unauthorised access to Pinsmack systems;
interfere with the normal operation or security of the Services;
use automated systems to scrape, extract or systematically copy Pinsmack content without permission;
distribute malicious software through the Services;
manipulate or abuse subscriptions, trials or promotions;
use Pinsmack for unlawful purposes; or
assist another person in doing any of these things.

16. Suspension and Termination

We may restrict, suspend or terminate access where reasonably necessary because:

you materially or repeatedly breach these Terms;
your subscription is no longer active;
payment legitimately due remains unpaid;
we reasonably suspect fraud or unauthorised activity;
your use creates a material security risk;
you seriously infringe Pinsmack's or another person's intellectual property rights; or
we are required to do so by law.

Where reasonably practicable and appropriate, we will provide notice or an opportunity to resolve the issue before terminating an account.

Nothing in this section limits rights you may have under applicable consumer law.

17. Account Deletion

You may request deletion of your Pinsmack account through the account deletion functionality provided by Pinsmack or by contacting support@pinsmack.com.

Deleting your account may permanently remove household profiles, reading progress, bookmarks, preferences and other account information. Certain records may be retained where required or permitted by law, as explained in our Privacy Policy.

Account deletion and subscription cancellation are separate processes where a subscription is managed by an external provider such as Apple or Google.

18. Service Availability

Pinsmack relies on software, networks, cloud infrastructure and third-party services.

From time to time, the Services may be temporarily unavailable because of maintenance, updates, technical failures, network problems or circumstances beyond our reasonable control.

We will take reasonable steps to maintain and restore the Services but do not promise uninterrupted or error-free operation.

Nothing in this section excludes rights or remedies that cannot lawfully be excluded.

19. Consumer Guarantees and Liability

Our Services come with rights and guarantees that may apply under the Consumer Law and other applicable laws.

These statutory rights cannot be excluded where the law does not permit their exclusion. To the extent permitted by law, McMouse Management Pty Ltd is not responsible for losses that are not reasonably foreseeable or that result from circumstances outside our reasonable control. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any rights or remedies available under applicable consumer protection law.

20. Third-Party Services

Pinsmack may interact with third-party services such as payment providers, app marketplaces and external platforms.

Those services may have their own terms and privacy policies.We are not responsible for third-party services that are outside our control, except to the extent responsibility cannot lawfully be excluded.

21. Privacy

Your use of Pinsmack is also subject to our Privacy Policy, which explains how we collect, use, store and protect personal information.

22. Changes to Pinsmack

We may update or change Pinsmack as the service develops, including by introducing new features, improving existing functionality or retiring features that are no longer reasonably supported. We will not use this provision to remove rights that cannot lawfully be excluded. If we make a material change that significantly affects an ongoing paid subscription, we will provide reasonable notice where practicable and any rights available to you under applicable law will continue to apply.

23. Changes to These Terms

We may update these Terms when reasonably necessary to reflect changes to Pinsmack, applicable laws, technology or our business operations. The updated Terms will be published with a revised Last updated date.

If a change materially affects your rights or obligations under an existing subscription, we will provide reasonable notice where required or appropriate. Changes will not retrospectively remove rights you have already acquired under applicable law.

Nothing in these Terms prevents you from exercising rights available under applicable consumer law or using an applicable court, tribunal, regulator or dispute-resolution process.

25. Governing Law

These Terms are governed by the laws applicable in New South Wales, Australia, and applicable Commonwealth laws of Australia.

Nothing in this section prevents a consumer from relying on any mandatory rights or protections available under the laws applicable to them.

26. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as severed or limited to the extent necessary.

The remaining provisions will continue to apply.

27. Entire Agreement

These Terms, together with the Pinsmack Privacy Policy and any specific subscription or promotional terms presented to you when you purchase a service, form the agreement governing your use of Pinsmack.
